Terms of use
These terms set out the rules for using Viquis 3D and the www.viquis.com website, and what happens when you buy Pro. We have written them in plain language. If anything is unclear, write to us at [email protected].
1. Who we are and what these terms cover
Viquis 3D is provided by Rita Raquel Carvalho Rodrigues de Oliveira, 3080-325 Figueira da Foz, Portugal ("we" or "us" in these terms). Contact: [email protected].
These terms apply to the www.viquis.com website, the online version of Viquis 3D (in the browser) and the Windows program, including updates. The agreement shown when you install the Windows program is a summary of these terms; if they differ, these terms prevail.
By using Viquis 3D you accept these terms. If you use it on behalf of a company or school, you confirm that you are authorised to bind it to them.
2. Words we use
- Free version: the features you can use without paying.
- Pro: the paid features, unlocked with a licence key.
- Licence key: the code you get after your purchase, in the store's customer portal.
- Activation: each computer or browser where the key is in use.
- Store: the payment service that sells the licences (see section 5).
3. The licence we grant you
Viquis 3D is licensed, not sold. We grant you a personal, non-exclusive and non-transferable right to use the program in accordance with these terms. The code, the Viquis name, the logo and the design of the program and website remain ours.
Free version: you may use it at no cost, with no time limit, on as many computers as you like, for personal or professional purposes.
Pro: you may use the Pro features in the version you bought (online, desktop or both), for the paid period and within the number of activations of that licence.
4. The Pro versions
- Pro Online: the Pro features in the online version, paid monthly or yearly.
- Pro Desktop: the Pro features in the Windows program, paid yearly, on one computer.
- Pro Complete: the Pro features in both versions, paid yearly.
Prices, what each version includes and the number of activations are shown on the pricing page and in the store. Your licence is governed by what was stated when you bought or renewed it.
Before buying, try the free version with your own files and check the computer requirements and file size limits (Requirements page). The minimum requirements are estimates.
Schools, companies and teams that need several licences can write to us.
5. Purchase, price and taxes
Licences are sold by a specialised online store acting as reseller ("merchant of record"): the store sells you the licence, takes the payment, issues the invoice and handles VAT and other taxes for your country. When you pay, you also accept that store's terms of sale, which are shown at checkout.
The final price, including your country's taxes, is shown in the store before you pay. Prices are in euros; if you pay in another currency, your bank or the store may convert it.
To buy, you must have the legal capacity to enter into contracts (usually, be of legal age) or the permission of someone who does.
After payment, your licence key is in the store's customer portal: you sign in with your purchase email and a code the store sends you. If you cannot find it, write to us.
6. Subscriptions, renewal and cancellation
All Pro licences are subscriptions: they renew automatically at the end of each period (month or year) and are charged to the same payment method until you cancel.
Cancelling: you can cancel at any time in the store's customer portal or by writing to us. Cancelling stops the next renewal; Pro keeps working until the end of the period already paid.
Price changes: if a subscription price changes, we will email you before your next renewal. The new price only applies from that renewal and you can cancel before it.
End of the licence: when the licence ends or is cancelled, the program returns to the free version. Your files and everything you exported remain yours and keep working.
Failed payment: if a renewal cannot be charged, the store retries for a few days; if it still fails, the licence ends.
7. Right of withdrawal, guarantee and refunds
Right of withdrawal (14 days): if you are a consumer, you can withdraw from your Pro purchase within 14 days of buying it, without giving a reason, and get a full refund. Just write to [email protected] with your purchase email. The refund is made by the store, to the same payment method, and the licence stops working. This period runs from the first purchase of each subscription; renewals do not reopen it.
Legal guarantee: Pro must work as described on the website. If it does not and we cannot fix it within a reasonable time, you are entitled by law to a price reduction or a refund. This guarantee does not depend on the right of withdrawal.
How to ask: write to [email protected] with your purchase email and, where relevant, a description of the problem. The store can also handle refunds and cancellations directly, under its own terms of sale.
If you buy as a business or professional, the consumer rights in this section do not apply; the general rules of law apply instead.
8. Activating and confirming the licence
To activate Pro, you paste the key into the app once, with an internet connection. The app asks our licence service to confirm the key with the store; the service returns a signed ticket, which is stored on your computer or in your browser.
After that, the app confirms the licence again every 7 days when online, and Pro keeps working for up to 35 days without a connection. If it cannot confirm within that time, Pro pauses until you are online again.
Each licence has a number of activations. To move to another computer, deactivate Pro on the old one (in the app's Pro window) and activate it on the new one; if you no longer have access to the old one, write to us.
Clearing your browser data, reinstalling Windows or switching browsers may require a new activation.
9. What is not allowed
When using Viquis 3D, you agree not to:
- share, publish, lend, resell or rent your licence key, or use it on more activations than you bought;
- circumvent, disable or forge the licence check, the signed ticket or the program's protections;
- copy, modify, decompile or disassemble the program, except to the extent expressly permitted by law;
- redistribute or sell the program, or include it in a product or service of your own, without our written permission;
- use the website, the online version or the licence service in an automated or abusive way (for example, to overload them or to test keys);
- use the program to infringe other people's rights, such as copyright, designs or trade secrets;
- remove the copyright and licence notices from the program.
10. Your files and what you create
The files you open are processed only on your computer. We do not receive, store or see them (see the Privacy policy).
Everything you create or export with Viquis 3D (STL, 3MF, PDF, images, videos, quotes, client packages) is yours. We claim no rights over those files.
You are responsible for having the right to use the files, images and text you open or put into the program (for example, a photo in a lithophane or a client's logo on a quote), and for what you share with others.
Keep backups of your files. The program does not change your original files, but we are not liable for data loss on your computer.
11. Measurements, quotes and other results
Measurements, volumes, masses, areas, holes, wall thicknesses, print times and costs, quotes and technical drawings are calculated from the 3D mesh and from reference values (densities, rates, speeds) that you should check or replace with your own.
In mesh files (such as STL), measurements follow the triangles, not the exact geometry of the part; volume and mass are only exact for closed meshes. Known limits are listed in the manual and on the Requirements page.
Viquis 3D is a support tool. It is not a certified measuring instrument and does not replace the source CAD program, the official drawing or a qualified person's check. Always confirm critical dimensions before manufacturing, buying or quoting, and whenever people's safety depends on the part.
12. Availability, updates and changes to the program
We do our best to keep the online version and the licence service available at all times, but there may be interruptions for maintenance or due to third-party failures (such as hosting or the store). The installed program keeps working offline, within the period in section 8.
We may update the program to fix bugs, improve security, keep up with changes in browsers and Windows, or add and revise features. Updates are free during your licence.
If a change significantly harms the Pro you paid for, we will tell you in advance; you may then end the licence and ask for a refund of the remaining part of the period.
The desktop version runs on the systems listed on the Requirements page. Older versions of Windows or browsers may stop being supported.
13. Warranties and liability
Beyond section 7 and what the law requires, Viquis 3D is provided "as is", with no promise that it is fit for a particular purpose or free of errors.
Free version: it is provided free of charge and everyone uses it at their own risk. We are not liable for damage arising from its use.
Pro: we are not liable for indirect damage, such as lost profits, lost customers, production delays or parts made with errors, caused by using the program's results without the check described in section 11. In all other cases, our total liability is limited to the amount you paid for Pro in the 12 months before the event.
These limits apply to contractual liability. They do not apply in cases of intent or gross negligence, to harm to life, physical integrity or health, to damage caused outside the contract, or where the law does not allow liability to be limited. Nothing in these terms takes away the rights your country's consumer protection law gives you.
14. Suspension and termination
You can stop using Viquis 3D whenever you like; for subscriptions, see section 6.
We may deactivate a key, warning you beforehand whenever possible, if it is used against these terms (for example, published online, shared or used on more activations than bought), if the payment is reversed or disputed without reason, or if it is used for fraud. In these cases the remaining period is not refunded, unless the law requires it.
If we stop selling or maintaining Viquis 3D, we will give at least 30 days' notice. Pro already paid for keeps working until the end of the period, or we refund the part of the price for the remaining period.
15. Open source and third-party trademarks
Viquis 3D uses open-source libraries, each under its own licence, which continues to apply to that part: three.js and three-mesh-bvh (MIT), OpenCASCADE through occt-import-js (LGPL-2.1), Manifold (Apache-2.0), qrcode-generator (MIT), Electron in the desktop version (MIT) and the Chakra Petch and IBM Plex fonts (SIL Open Font License). The texts of those licences come with the program or you can ask for them by email.
Names of other companies' formats and programs (such as STEP, SolidWorks, Windows, Bambu Lab or Prusa) are trademarks of their owners and appear only to say which files and programs Viquis 3D works with.
16. Privacy
How we handle personal data (licences, purchases, emails and the website) is explained in the Privacy policy.
17. Changes to these terms
We may change these terms, for example when we add versions, change store or the law changes. The date of the latest version is at the bottom of this page.
If the change is significant, we will announce it on the website and email subscribers at least 30 days before it takes effect. For subscriptions, the new terms apply from the next renewal; if you do not agree, you can cancel before it.
18. Governing law and disputes
These terms are governed by Portuguese law. If you are a consumer living in another country, you keep the protection of the mandatory rules of your country's law.
If you have a complaint, please write to us first at [email protected]: we always try to sort it out directly.
If you are a consumer, you may also use an alternative consumer dispute resolution body. In Portugal: CNIACC — Centro Nacional de Informação e Arbitragem de Conflitos de Consumo (National Consumer Arbitration Centre, www.cniacc.pt). More information at www.consumidor.gov.pt.
The Portuguese courts have jurisdiction, without prejudice to a consumer's right to go to the courts of the country where they live.
19. Languages, final provisions and contact
These terms exist in several languages. If the versions differ, the Portuguese version prevails, unless your country's law requires otherwise.
If any part of these terms cannot be enforced, the rest remains valid. Not exercising a right does not mean we waive it.
For any question about these terms: [email protected]. We reply on working days.
